국내외의 법여성학의 현황 및 국내 젠더법학회에서의 활동을 중심으로, ‘자기 결정권’에 대해 알아본다. 특히 여러 종류의 커뮤니케이션 상황에 놓인 여성의 개인적이고 사회적인 신체에 대한 자기 결정권이 행사되는 메커니즘을 이해해 본다. 호주제 폐지, 낙태의 권리, 개인 정보 관리, 등의 구체적인 사례에서 도출되었던, 혹은 현재에도 논쟁적인 법적 쟁점들을 정확히 알아 본다. 각각의 경우에서, 개인의 신체 혹은 존재 상황이 사회적 맥락 안에서 형성되고 훼손되는 지점들, 혹은 법의 구제로 복구되는 영역, 혹은 법의 언어로 누락되는 신체의 부분들을 인식해 본다.
This lecture will examine “the right of self-determination,” focusing on the current status of feminist jurisprudence in Korea and abroad, and the activities of the Gender Law societies in Korea. In particular, we will try to understand the mechanisms by which women's self-determination of their personal and social body is exercised in various situations of communication. We will try to understand the legal issues through concrete examples such as the abolition of the patriarchal family system, abortion rights, and personal information management, or even the current, ongoing, controversial issues. In each case, we will try to recognize the points at which the individual's body or existence is formed and destroyed within the social context, the domains that are restored by remedying the law, or parts of the body that are omitted by legal terminology.

서울대학교에서 학사와 석사과정을 마치고, 미국 The New School Social Research 에서 사회학 박사학위를 받았다. 『가지 않은 길, 법여성학을 향하여』(사람생각, 2004), 『성적 소수자의 인권』(사람생각, 2002), 『강제로 끌려간 군위안부들 IV-기억으로 다시 쓰는 역사』(풀빛, 2001), 『군대와 성평등』(경인문화사, 2009) 등의 편자이며, 포스트식민주의, 페미니즘 이론, 피해자 증언 방법론, 일본군 성노예제, 가족제도 등에 관해 연구해 왔다. 서울대학교 법학전문대학원 부교수로 재직 중이며 국가인권위원회 인권위원으로 활동하고 있다.
Hyunah Yang (Professor, School of Law, Seoul National University)
After graduating from Seoul National University with BA and MA, Hyunah Yang received her doctoral degree in sociology from The New School Social Research, United States. She has edited the following books: “The Road Not Taken, Toward the Feminist Jurisprudence” (Saram Saenggak 2004), “Human Rights of Sexual Minority” (Saram Saenggak, 2002), “Forcibly Taken Comfort Women IV - Rewriting History via memory” (Pulbitbooks, 2001), “Kundae wa sŏng p'yŏngdŭng [Military and Gender Equality]” (Kyŏngin Munhwasa, 2009). Her research includes studies on post-colonialism, feminist theory, victim testimony methodology, Japanese military sex-slavery, and family system. She is an associate professor at the Law School of Seoul National University and works as a commissioner of the National Human Rights Commission.
