온라인 환경이 구축되고 있는 정책적 맥락들, 그 안에 존재하는 법적 쟁점들을, ‘컨텐츠 제작자들’에게 부여된 제한, 한계, 책임, 윤리를 키워드로 살펴본다. 인터넷 환경에서의 (표현, 배포, 수용 등에 있어) 제한과 한계에 대해, (기술/매체의 사용에 있어) 책임과 윤리에 대해, 원론적이며 다각적으로 논쟁해 볼 수 있는 쟁점들을 짚어 본다. 『진실 유포죄(2012)』를 강연의 밑그림으로 삼아, 작년 메갈리안 이슈를 비롯, 방송통신심의위원회 활동에서 마주했던 젠더 이슈들을 살펴 본다.
This lecture will examine policy contexts that form the basis of the online environment, and the legal issues that exist within it, in terms of keywords restrictions, limitations, responsibilities, and ethics assigned to “content creators.” We will also examine restrictions and limitations in the internet environment (regarding expression, distribution, and acceptance), the responsibility and ethics (in the use of technology/media), and issues that can be argued in a fundamental and multidimensional manner. Using “Guilty of Spreading Truth” (2012) as an outline for the lecture, we will investigate issues related to gender that we have encountered, such as the “Megalian” issues of last year and the activities of the Korea Communications Commission.
박경신 (고려대 법학전문대학원 교수)
하버드대학교 물리학과를 졸업하고 UCLA 로스쿨에서 J.D. 학위를 받았다. 현재 고려대학교 법학전문대학원에서 교수로 재직 중이며 방송통신심의위원회 심의위원으로 활동하고 있다. 현재 표현의 자유, 언론개혁, 사법개혁, 국민의 알 권리 등의 영역에서 적극적인 활동을 벌이고 있다. 인터넷법 클리닉(WWW.INTERNETLAWCLINIC.ORG)을 개설하여 네티즌들과 독립예술가를 위한 저작권 및 명예훼손 등의 무료 법률상담을 하고 있다. 그동안 『사진으로 보는 저작권, 초상권, 상표권 기타등등』을 썼고 『호모 레지스탕스』 『자유주의의 가치들』 『떼법은 없다』 등을 공저했으며, 『생명의 지배영역-낙태와 안락사에 대한 일고찰』 『해상사고선주책임제한 주요 판례집』 등을 편번역했다.
Kyung-Sin Park (Professor, School of Law, Korea University)
After graduating from Department of Physics, Harvard University, Kyung-Sin Park received a J.D. from the University of California, Los Angeles, School of Law. Currently, he is a professor at Korea University School of Law and a committee member of the Korea Communications Standards Commission (KCSC). He is actively engaged in areas such as freedom of expression, media reform, judicial reform, and the people's right to know. He established the online Legal Clinic (WWW.INTERNETLAWCLINIC.ORG) and offers free legal counseling against copyright infringements and defamations, among other issues, for netizens and independent artists. He has authored “About copyrights, portrait rights, trademark rights, etc. via photos,” and co-authored “Homo Resistance,” “The Values of Liberalism,” and “There is no Mob-Law,” and edited/translated Ronald Dworkin’s “Life's Dominion-An Argument about Abortion, Euthanasia, and Individual Freedom” and “Maritime accident owner liability limitation major precedent cases.”
